These Terms of Service ("Terms") govern your access to and use of The Outreach ("the Service"), operated by The Outreach ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. The Service
The Outreach is a web-based outreach management tool that helps individuals and teams send, track, and follow up on relationship-driven email campaigns. The Service connects to your Gmail account via Google OAuth and sends emails on your behalf through your own Google account.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you confirm that you have the legal capacity to enter into a binding agreement.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@theoutreach.xyz if you suspect any unauthorised access.
4. Acceptable use
You agree to use the Service only for lawful purposes. You must not:
- Send unsolicited bulk email (spam) or use the Service to harass individuals
- Upload contact lists obtained through scraping, purchased databases, or any method that violates the consent of the recipients
- Violate any applicable law, including anti-spam laws such as CAN-SPAM, GDPR, or CASL
- Impersonate any person or entity or misrepresent your affiliation
- Attempt to gain unauthorised access to our systems or another user's account
- Use the Service to send content that is illegal, harmful, or deceptive
We reserve the right to suspend or terminate accounts that violate these rules without notice.
5. Gmail integration
The Service uses Google OAuth to connect to your Gmail account. By authorising this connection, you grant us permission to send emails and read inbox metadata (subject lines and sender addresses) for reply detection on your behalf. We do not read, store, or process the body content of emails in your inbox. You can revoke this access at any time through your Google account settings.
6. Subscriptions and billing
Paid subscriptions are billed monthly in advance. All payments are processed securely by Paddle, our authorised reseller. By subscribing, you authorise recurring charges to your payment method. Prices are listed in US dollars and are subject to change with 30 days' notice.
Your subscription will automatically renew each month unless you cancel before the renewal date. Cancellation takes effect at the end of the current billing period. You will retain access until then.
7. Free tier
We offer a free plan with limited features. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.
8. Intellectual property
The Service, including its design, code, and content, is owned by The Outreach and protected by applicable intellectual property laws. You retain ownership of all content you create or upload (contact lists, email templates, campaign data). You grant us a limited licence to store and process that content solely to provide the Service.
9. Data and privacy
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranty of any kind. We do not guarantee that the Service will be error-free, uninterrupted, or that emails sent through the Service will be delivered successfully. Email deliverability depends on factors outside our control, including your Gmail account standing and recipient mail servers.
11. Limitation of liability
To the maximum extent permitted by law, The Outreach shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
You may delete your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your data will be retained for 30 days before permanent deletion, during which time you may request an export.
13. Changes to these Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of Israel. Any disputes shall be resolved in the courts of Tel Aviv, Israel.
